Nudity is one thing, and nudity while giving labor is another thing. Either way, consent is needed before such content is published to the internet.
Fitri Andarista is a dangdut singer from Banyuwangi, located at the far eastern end of the island of Java, Indonesia.
And this time, a video showing her during labor, while giving birth to her first child, was uploaded to YouTube, and Fitri admits feeling embarrassed because the video has been viewed by thousands of viewers.
The video in question was taken while she was giving birth at a midwife's place in Purwodadi Village, Gambiran District, near her husband's house.
At that time, the husband was present during the birth of their first child, and was wearing a Go Pro device on his head to record pretty much everything he saw during the labor.
The thing is, Fitri said that she didn't know that she was being filmed at that time.
In the video, she is seen naked, and getting prepared for labor, and had her breasts and nipples, as well as her pubic region clearly visible.
There is also the moment where her husband and one of the midwives gave Fitri a nipple stimulation, a method to help the body release the hormone oxytocin, which can help initiate labor and makes contractions longer and stronger.
"Well, of course, I'm embarrassed. [...] I was naked while struggling to give birth. It was from the beginning until my child was born, everything was visible, not censored at all," she told reporters.
This angered her to a degree that she files a case.
"The camera was positioned above (recording). So, I didn't know. Yes, everything was visible, from my breasts to my genitals. Only my stomach was covered," she added.
Fitri only realized about the existence of the video, after she was informed by one of her friends.
When she saw it, some 12 thousands people have viewed it.
"Yes, I knew from a friend. But on January 21, it was said to have been deleted. It disappeared from YouTube when I searched it," she added.
Nevertheless, she already has evidence of the screenshot of the upload.
Not only that, she also downloaded the video as proof to strengthen her report.
The whole video is about 40 minutes long, and many of the video that is still circulating on the web, many of which on adult websites, are cropped to only a few minutes long, using titles like video edukasi, Indonesian for "educational video".
It's worth noting that Fitri gave birth on December 21, 2015, and divorced in 2016.
The video was uploaded to the internet on January 25, 2019.
"Our client reported her ex-husband. The video was watched by around 12 thousand viewers. Whereas our client and HR had officially divorced on October 27, 2016," said Fitri Andarista's lawyer, Zaeni, to reporters.
"HR uploaded it to YouTube without permission. It has been deleted now. But we have evidence. We reported it last February 1."
Zaeni stated that the video is highly inappropriate for public viewing as it invades privacy. Her client claimed not to have been aware that her childbirth was being recorded by her ex-husband.
"She was unaware she was being recorded. Yes, from her head, nipples, and genitals, as well as during contractions, are in the video," Zaeni revealed.
Zaeni said that they have reported the husband under the ITE Law, or Information and Electronic Transactions Law (Undang-Undang Informasi dan Transaksi Elektronik), which is an Indonesian law that governs electronic information and transactions.
Enacted in 2008, the ITE Law regulates various aspects of online activities, including electronic transactions, data protection, cybercrime, and freedom of expression in cyberspace..
The Head of Criminal Investigation Unit of Banyuwangi Police, Panji Prathista Wijaya, admitted to receiving reports regarding the alleged spread of the childbirth video of the Banyuwangi dangdut singer.
"We have received it. We will still clarify with the complainant. This case is still under investigation," he said.
Dangdut is a genre of popular music that originated in Indonesia in the late 1960s.
It is a fusion of various musical influences, including traditional Indonesian music, Indian film music (known as Bollywood), Malay folk music, and Arabic music, combined with Western pop and rock.
